1. General Provisions

1. [Agreement Validity] This "PawBallet User Agreement" (hereinafter referred to as "this Agreement") is a legally binding agreement between the user (hereinafter referred to as "you") and MMDL STAR LLC, the operator of the PawBallet mobile application (hereinafter referred to as "PawBallet", "APP", or "we") regarding the use of the PawBallet APP and related smart pet services. By selecting an acceptance control that refers to this Agreement, you agree to its terms. Acceptance of this Agreement does not replace any separate permission or consent required for particular data uses.

2. [Service Scope] PawBallet is an intelligent pet care application that supports binding pet cat face recognition feeders and pet cat face recognition litter boxes (hereinafter collectively referred to as "bound devices"), providing you with device binding management, function control, data viewing, pet health tracking, device status monitoring, third-party authentication (such as Google Sign-In), and other related services. To use this APP service, you must ensure that you legally own the corresponding bound device and that the device meets the adaptation standards specified by this APP.

Available functions depend on the compatible device model and APP version.

3. [Agreement Changes] We reserve the right to modify the content of this Agreement according to business development, updates to laws and regulations, etc. The modified agreement will be notified to you through in-APP announcements, push notifications, etc. We will give reasonable advance notice of material changes and obtain affirmative agreement where required by applicable law. Changes will not retroactively remove accrued rights. If you disagree, you may stop using the APP and related services.

2. User Qualifications and Account Management

1. [User Qualifications] You confirm that at the time of registering for and using this APP service, you are at least 18 years old, meet any higher age of majority where you live, and have legal capacity to enter into this Agreement.

2. [Account Registration and Use] You need to complete registration through email address, or Google account/Apple ID, to create an exclusive account. You should provide true, accurate and complete registration information, and shall not register using another person's information without authorization. You shall be responsible for the security of your account and password, and are responsible for losses to the extent caused by your misuse or unauthorized disclosure of credentials. This does not make you responsible for our failure to meet our legal obligations. Without our written consent, you shall not transfer, rent, lend or authorize others to use your account.

3. [Account Cancellation] You can apply for account cancellation through the settings function in the APP. After account cancellation, you will no longer be able to log in to the APP using that account, and personal information, device binding records, usage data, etc. related to that account will be processed in accordance with the provisions of this Agreement and the Privacy Policy. Please back up important data.

3. Service Content and Usage Specifications

1. [Service Provision] We will make every effort to provide you with stable and secure APP services, including but not limited to: device binding and unbinding, cat face recognition function settings, feeding plan formulation and execution, litter box usage data statistics, device failure reminders, etc. You understand and agree that some services may depend on the network environment and the normal operation of the bound device. We shall not be liable for service interruptions caused by reasons beyond our control, such as network outages or device failures.

2. [Device Usage Specifications] You should use the device correctly in accordance with the device manual and APP guidelines. You shall not perform unauthorized operations such as modification, disassembly, or rooting of the device, and shall not use the device to engage in activities that harm pet health, violate public order or good customs, or violate laws and regulations. You shall bear all responsibilities for device damage, pet injury or other losses caused by your unauthorized use of the device.

3. [Data Usage Specifications] You agree that we may collect, store and use relevant data generated during your use of the APP and device, including but not limited to device binding information, pet recognition data, device usage records, function setting data, etc. The collection and use of relevant data will strictly comply with the provisions of the APP's Privacy Policy. You shall not tamper with or forge data displayed in the APP, and shall not use data to engage in illegal activities.

4. [Prohibited Behaviors] When using this APP service, you shall not engage in the following behaviors:

(1) Behaviors that violate laws and regulations, national policies, and public order and good customs;

(2) Behaviors that infringe upon the intellectual property rights, privacy, reputation, and other legitimate rights and interests of others;

(3) Uploading or spreading files containing viruses, malicious codes, or other harmful content;

(4) Interfering with the normal operation of the APP, attacking the APP server, or tampering with the APP program;

(5) Other behaviors that damage the legitimate rights and interests of us or third parties.

4. Privacy Protection

1. We highly value your privacy protection and will properly protect your personal information and pet-related data in accordance with applicable United States federal and state privacy laws, as well as the APP's Privacy Policy.

2. For pet recognition information such as your pet's cat face recognition data, we only use it for the purpose of device pet identification and providing corresponding services. We will adopt encryption and other security technical measures for storage and protection. We will not sell or rent your personal information or pet-related data. We will not disclose or share pet recognition data without your explicit consent, except as described in the Privacy Policy or required by law.

3. You have the right to view, modify and delete your personal information and pet data. You can exercise the above rights through relevant functions in the APP or by contacting customer service.

5. Intellectual Property

1. The software copyright, trademark rights, patent rights and other intellectual property rights of this APP are owned by us or our licensors. Without our written permission, you shall not copy, distribute, adapt, reverse engineer or decompile any content of this APP, except as permitted by applicable law or an applicable software license.

2. The intellectual property rights related to the bound device are owned by the device manufacturer. This Agreement does not involve the transfer or license of device intellectual property rights. Your use of the device shall comply with the relevant regulations of the device manufacturer.

6. Disclaimer and Limitation of Liability

1. We shall not be liable for any compensation for the inability to provide APP services normally due to force majeure (such as earthquakes, typhoons, fires and other natural disasters), government actions, network outages, device failures and other reasons beyond our control.

2. To the extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential losses arising from your use of this APP service or bound device. This does not exclude liability for our fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded.

3. Except for our express commitments and to the extent permitted by law, we do not warrant that this APP service will be uninterrupted, error-free, or free from defects. Any exclusion of implied warranties applies only to the extent permitted by law.

4. Nothing in this Agreement limits written product warranties, product safety obligations, liability for personal injury or death that cannot lawfully be limited, statutory privacy remedies, or other nonwaivable consumer rights. If your state does not permit a limitation, that limitation does not apply to you.

7. Changes, Suspension and Termination of Services

1. We reserve the right to change or suspend part or all of the APP services according to business adjustments, technical upgrades, etc., and will notify you in advance through APP announcements, etc.

2. If you violate the terms of this Agreement, we reserve the right to suspend or terminate the APP services provided to you, subject to applicable law and any applicable refund rights for fees already paid, and reserve the right to pursue your liability for breach of contract.

3. If the bound device manufacturer stops producing or maintaining the device, or the device is no longer compatible with this APP, we reserve the right to terminate support services for that device and will notify you in advance.

8. Dispute Resolution

1. The conclusion, performance, interpretation and dispute resolution of this Agreement shall be governed by Nevada law and applicable United States federal law, without depriving you of mandatory protections under the law of your state of residence.

2. Please contact support@pawballet.com so we can try to resolve a dispute. This does not prevent you from pursuing a legal remedy or extending a legal deadline. Subject to any nonwaivable right to proceed elsewhere, disputes may be brought in courts with jurisdiction in Clark County, Nevada. Either party may use a small claims court with jurisdiction.

9. Other Terms

1. This Agreement applies when you accept it as described in Section 1.

2. For matters not covered in this Agreement, reference may be made to the APP's Privacy Policy and other relevant rules.
